KENNEWICK A Prosser High graduate who never expected a senior prank would end up costing a half-million dollars in cleanup and repairs asked a judge Friday to give him a second chance.

Jorge. E. Luna Guerrero, 20, said it took being incarcerated the past seven months to realize how his mom has struggled so he could have a better life in the United States, and he might have squandered it away to have fun just days after 2011 commencement ceremonies.

Luna Guerrero is not legally documented to be in this country and could be sent back to Mexico based on his felony convictions for vandalizing Prosser High School on two separate occasions, his lawyer said.

The young man requested a sentence within the standard range, which called for a maximum year in jail. A less lenient sentence might have prevented his potential deportation.

However, Judge Vic VanderSchoor said it wasn’t right for Luna Guerrero’s punishment to be different than in the case of his co-defendant, who was sentenced in December.

He ordered Luna Guerrero to serve two years in prison.

“Sir, I’m not going to say you’re a bad person, but you made a bad mistake. And I do hope that your statements you made are sincere and I do hope that you follow those,” VanderSchoor said, noting that Luna Guerrero has a long life ahead of him. “Hopefully I never see you again, in this arena at least.”

Luna Guerrero pleaded guilty Nov. 21 in Benton County Superior Court to six felony counts, just hours before he was to face a jury.

He was among five suspects who vandalized the school on three separate nights last spring, including twice after graduation. His involvement was on June 6 and 16.

Luna Guerrero’s criminal case was the last to be resolved.

His guilty pleas were for two counts each of second-degree burglary and third-degree theft, and one count each of first- and second-degree malicious mischief.

The first-degree malicious mischief charge includes the aggravating circumstance that it was a major economic offense.

That is what allowed Deputy Prosecutor Kristin McRoberts to recommend an exceptional sentence that is double the top of the standard range.

“The damage in this was extreme. It’s probably the worst malicious mischief case that our office has ever filed,” McRoberts told the court. “We’re dealing with a case here where damages are 120 times the statutory amount required to commit malicious mischief in the first.”

The charge is defined as causing physical damage to another’s property in an amount exceeding $5,000.

BELFOR Restoration billed $462,000 for work after the final incident — almost $220,000 of that was labor costs because the cleanup extended over the summer — and the Prosser School District submitted a separate $170,000 tab to deal with destroyed vending machines and replace furniture, appliances, a copy machine, doors and the security system, McRoberts said. That last number doesn’t include school staff time that was wasted to complete the repairs or wait for contractors to come in, she said.

“Given the extreme amount of damage … double the standard range really is a reasonable recommendation,” McRoberts said.

On June 6, Luna Guerrero and Benjamin Velasquez climbed trees, entered the school through windows and painted the security cameras black in an attempt to conceal their identities. They were wearing all black, including face masks.

The two “made a mess of the school,” McRoberts said, breaking ceiling tiles, leaving graffiti on walls, painting over pictures, shattering a display case and stealing an autographed Boise State University football jersey that belonged to former Prosser football star Kellen Moore.

Luna Guerrero and Velasquez were joined by two other friends that night.

Then 10 days later, Luna Guerrero and Velasquez returned to the school late at night and tried to disable the security, ultimately destroying the system, McRoberts said.

They found paint cans in the janitor’s closet and tossed them about, dumping paint on furniture in the teacher’s lounge, where they also removed all food from the refrigerators. They tried to flood a bathroom by clogging the sink and running the water, sprayed soda bottles in the hallway, damaged an expensive copy machine and stole items including a TV, digital recorder and a football and jersey from Principal Kevin Lusk’s college days, she said.

But the most significant and expensive damage was from every single fire extinguisher in the school being discharged. A cleaning crew had to hand wipe that layer of dust off everything, which even involved going over each book in the library, she said.

Luna Guerrero said a couple of teens were happy they had graduated and didn’t intend to hurt anybody when they set out on their senior prank, but it went too far.

“I didn’t think I’d be facing what I’m facing right now for what I did,” he said.

Acting Principal David Funk addressed the judge Friday on behalf of Prosser High’s students and staff and the community, saying they are disappointed in Luna Guerrero’s actions.

“Such actions are not the way we treat each other, your family, your school and your community,” Funk said. “We can only hope that you will learn a lesson through all of this. … We hope that you will grow as a result of fulfilling your responsibility to pay restitution, and it’s our deepest hope that you can emerge from this as a productive member of our community.”

Funk wished Luna Guerrero the best of luck.

Defense lawyer Sam Swanberg, in his push to get a normal sentence, requested two Prosser police officers to speak at the sentencing about Luna Guerrero’s cooperation and demeanor during the investigation.

Detective Mark Cole said when they arrested Luna Guerrero and got him to the police station, he was “very respectful, answered all my questions, didn’t lie to me and just appeared to be a nice, young man.”

“I do believe he needs to be accountable for his actions. I hope that he makes better choices in the future,” Cole said. “I ask that the court have mercy for him, but hold him accountable.”

Detective Ed Blackburn said he has known Luna Guerrero for a while and in every dealing the young man has been respectful. Blackburn said he has no clue why Luna Guerrero decided to go through with these two crimes.

“When served at the scene with a warrant (Luna Guerrero) was confrontational and challenging. But within minutes of that, when he realized the gig was up, he became very compliant and cooperative and all,” he said. “… I don’t think that Jorge deserves any less than the other defendant or any more. I think he should be treated equally there.”

Swanberg told the court that his client didn’t have a vendetta against the school. It was a prank that went greatly awry, and now Luna Guerrero will face additional punishment because of his immigration status, he said.

Luna Guerrero said he didn’t have a focus in life before these crimes and “just let life go by,” but being locked up has opened his eyes and helped him to gain “much wisdom, discipline and understanding.”

Luna Guerrero said he has lived in Prosser since he was a young boy and his only family is his mother and two younger brothers. He said if he is sent to Tijuana, Mexico, he has no relatives there, and wishes he would have realized sooner his mother’s love and how she worked hard to give him a decent and safe upbringing.

Luna Guerrero said he views this conviction and sentence as a setback in life, albeit a painful one, but is ready to get back on track. He acknowledged that if it weren’t for these crimes, he could be in college right now.

“I’m truly sorry for what I did to the community of Prosser. I do regret what I did, I truly do,” Luna Guerrero said. “But the lesson learned, what I got from this, was something that I really needed.”

Pam Strickland is now washing dishes by hand after her dishwasher nearly caught fire the last time she tried to use it. The scorch marks on the control panel show where the machine was smoldering, until she cut the power.

“The control panel was bright red, and there was a lot of smoke coming out, and I did not know, at that point what was going on,” Strickland said.

She generally sets the dishwasher to turn on when her family is asleep and shudders to think what might have happened if she and her daughter weren’t watching a movie.

“It was pretty scary, because if we weren’t up at 1:30 in the morning, I’m afraid to think about what could’ve happened,” shuddered Strickland.

Despite the close call, she says the dishwasher manufacturer, Whirlpool, has not been much help, telling her the machine is out of warranty. It’s the same line Whirlpool has been giving hundreds of other owners of their dishwashers – like John and Irma Jarvis of suburban Chicago – whose KitchenAid dishwasher was also made by Whirlpool.

Irma said, “The kitchen was full of smoke. All of the alarms went off. I could have lost my children, my husband, my dog, everything!”

Strickland and the Jarvis’s have found out they have plenty of company. They found a website started by a victim of a KitchenAid dishwasher fire and more than 500 owners are now listed on the site.

Many have also joined a class action lawsuit, alleging Whirlpool dishwashers, also marketed under the brand names KitchenAid and Kenmore, have “a dangerous defect known to the manufacturer” but concealed from the public – “electronic control boards that spontaneously overheat and cause the dishwasher to emit smoke and fumes and erupt in flames.”

KitchenAid owner Michael O’Beirne said, “The whole control panel area right through here was glowing red. The circuit board was on fire underneath it.”

“It is a very scary thing. You expect an appliance to break down, not start a fire in your house,” said Strickland.

An investigation into appliance fires highlights the latest issue of Consumer Reports, which found the government has recalled more than seven million dishwashers in the last five years, including Maytag dishwashers in June of 2010.

Iceman almost missed his opportunity at love because his future wife was a smoker; eventually she quit. And not surprisingly, given the number of journalists around these parts, there were several stories of newsroom meetings, besides my own: one at the AP, the other at Dow Jones.

But the story that charmed me most was Charlie B.’s story of meeting his wife during an AIDS walk in 2001. Love was the last thing he expected when he rolled out of bed that day, sparks flew when they were introduced, she ditched him during the walk, he spotted her later in the crowd, and devised a way to meet up with her again and make it look accidental.

Sunday, May 20th, 2001, was the first brilliantly sunny and warm day in an otherwise dull gray Spring. If it had been anything but a perfect day, I would have characteristically slammed the alarm off at 8:00am, but it was AIDS Walk Day. For those of us regulars at Congregation B’nai Jeshurun of the Upper West Side, AIDS Walk was very important, almost a “High Holiday” because the synagogue not only fields one of the largest teams, but also is still a primary fund-raiser. Volunteers started recruiting in January for the May event. The rabbis hit hard from the pulpit for months, “It’s a mitzvah (good deed)!” “Support our LGBT brothers and sisters!” “Help with Tikkun Olam (fixing the world)!” and the most crass, “Who knows? You might meet someone.” So as I got out of bed to do my good deed, I thought I was hardly going to meet the girl of my dreams at a LGBT event so I didn’t even bother to shower or shave; I pulled on a pair of dirty jeans, employed the fail-safe baseball hat trick to cover my bed-head, and off I went.

I can point to you the exact spot in front of Bethesda fountain where my friend Stephanie said, “This is my friend Nancy.” Although Nancy looked like film star on our wedding day, she will always be most beautiful to me as she was on that day; without any make up, wearing shorts and a simple t-shirt and her hair in a pony-tail. We chit-chatted and hung around until the walk started, but then I lost her. When Stephanie invited Nancy to come along, she also suggested that Nancy could meet someone too. For Nancy that was the furthest thing from her mind because she was walking and raising money in memory of a good friend lost to AIDS. In fact, so she says today, Nancy wanted to prove her friend wrong and ditched me on purpose.

I kept watch as we walked along the Eastside of the loop and finally spotted Nancy diagonally across the park just rounding the edge near 110th St. towards the Westside loop. As a native Manhattanite who practically grew up in Central Park, I knew a shortcut from where I was that would put me slightly ahead of her on West 96th Street. I bolted.

To Nancy our meeting was serendipity, to me a well-executed strategy. We walked to the finish line and then went to the boat house for coffee by the pond. Four months later we were engaged, and this October we will celebrate 10 years of marriage with our three kids and many friends. It is a wonderful story and we continue to support the Gay Men’s Health Crisis because really the best ending of the story would be, and the one for which we dearly pray, “And eventually enough money was raised to find a cure for AIDS and everyone lived happily ever after.

But as his motorcade shut down several blocks of traffic in one posh Orange County neighborhood, a bystander expressed the resentment that inevitably trails a president on such a purely political mission:

“That’s our money at work,” the woman shouted at the president’s 17-vehicle procession.

And, indeed, Obama’s fundraising success – $29 million in January, the campaign announced Friday – relies heavily on the panoply of presidential perquisites, armored limousines, helicopters, Air Force One.

As presidents and their campaigns are required to do under federal election rules, the Democrats will reimburse the government for part of the cost of Obama’s travel. They’ve handed over more than $1.5 million so far this election cycle.

But although that’s a considerable sum, it’s nowhere near the actual cost of transporting the leader of the U.S. and all the people and equipment that have to move along with him.

A traveling White House entails a huge team of advance workers, vehicles, military and civilian personnel, as well as a vast security network. The presidential plane, a modified Boeing 747, costs at least $57,000 per hour to operate, the amount the Air Force publicly estimated in 1998.

Under federal rules that have been in force for decades, the president’s campaign reimburses the government at a much lower rate – the equivalent of the commercial airfare for himself and any staff who are traveling for fundraising or other nonofficial work, as well as their costs for food and lodging.

After waking up at the Beverly Hilton Hotel on Thursday, Obama didn’t have to slog through the snarl of morning traffic in Los Angeles.

Instead, the president was shuttled to a nearby park where several helicopters were waiting for him, his staff and the media that trail him. What could have been a two-hour trip to an Orange County donor’s oceanfront home took just under 40 minutes.

That pace makes these high-maintenance trips worth it. Taking account of the time the president spent at campaign events and en route to them this week, Obama was raising nearly $6,000 per minute.

A $500 million construction package aimed at stimulating job growth has cleared the state Senate.

The “Invest in Hawaii Act of 2012″ would fund numerous capital improvement projects across the state. These repair and maintenance projects would update aging infrastructure at state facilities and address health and safety concerns.

The bill focuses on funding projects that are ready to begin to avoid delay in creating much-needed construction work. 

The capital improvement projects would also help Hawaii businesses that provide supplies and other support to the construction industry.

The state’s estimated repair and maintenance backlog exceeds $1 billion. If the bill also clears the House, funding would be available for public works projects at schools, health centers and other state-owned properties.

02/21/12 There are truly exciting developments afoot in the field of robotics. Uncomfortably humanlike Japanese toys aside, we are starting to see more and more applications for robot technology gaining steam in the market.

According to the Japan Robotics Association, the consumer robotics market is projected to reach 24 billion this year, and balloon to 66 billion by 2025. I personally think that the long term estimate is a bit pessimistic. Bill Gates is on record for predicting that robots will be as common as computers are today.

If he is even half right, investors that get in on promising techs today will be fantastically compensated for their vision and patience in the long run. Getting in on the next wave of robotics now will be like getting in on Intel, AMD, Apple, and Microsoft in the 1980s.

Of course, the Great Recession has dealt a few temporary blows. A mainstay of the robotics industry has been assembly line machines for the automobile manufacturers. But the robotics industry is diversifying, and the automotive industry itself gives a good example of what can happen.

While automobile sales plummeted during the Great Depression, crucial improvements in automotive technology like the fully automatic fluid transmissions and hydraulic brakes were being made that would revolutionize motoring once it was all over. Once that storm passed profits and sales went up, along with share prices.

Robots are already being used for dangerous jobs that humans would rather not do. The US Commerce Department decided to fund a project with Fibrwrap Construction Inc. to develop robots that will be able to repair aging water transmission pipelines from the inside. The advantage of this method is that the infrastructure won’t have to be torn out of the ground to be repaired. But the robotics market is rapidly spreading beyond these types of dangerous applications…

Robotics is being aided by a simple economic fact: while cost of production for goods has generally declined over time, prices for services generally don’t fall quite as much. Consider that your computer costs a fraction for the performance you receive compared to two decades ago, but the technician that repairs it has generally remained quite expensive to hire.

Food prices, to give another example, have fallen steeply in real terms over the last century. This is not only due to better agricultural techniques, but also because of increased automation. From John Deere and Alice-Chalmers, from the balers to combines, mechanized agricultural equipment has drastically reduced what we have to pay to consume our daily bread. Robotics will be no different, and we are on the cusp of big changes.

In our day and age, the healthcare service industry has proven highly resistant to price declines partly because of labor costs. Improved robotic automation is one of the fastest ways to increase productivity and reduce labor costs. With the leading edge of the Boomer generation entering retirement, there will be huge financial incentives for improved robots. There will be tremendous demand for anyone that can build an affordable robot that can help with housekeeping and basic care.

Families that want to keep older members out of assisted care facilities and closer to home will look to robots for help.

I spoke with Martin Spencer, President of GeckoSystems International Corp. regarding his vision for robot assisted health care. Having spent over a decade working on his dream of a personal care robot, his company has developed unique technology that is starting to demonstrate its usefulness in marketable models.

According to Spencer, the hardest problems related to robotics in this role are software and AI related, not hardware related.

Their flagship robot, called CareBot, has advanced modular artificial intelligence and a proprietary compounded sensor system that allows it to reliably move about the typical home landscape. Unlike other robot designs that seek to reduce sensor inputs to cut down on processing overhead, GeckoSystems’ CareBot is sensor loving. This property is necessary if a viable multipurpose self-directed robot is to become successful. The main reason is because multiple inputs help to give the robot a better reading on its environment. For example, when you are driving a car, you not only receive inputs through your vision, but also through the sensing of acceleration or deceleration, engine vibration, a honk from a nearby car, or the bump of a collision. Being able to use multiple sensor feeds is particularly important in a robot that needs to move about the home on its own.

The CareBot also has an AI module that is designed for human/robot interactions.

This module, called GeckoChat, can respond to voice requests, create voice reminders, and even engage in word games with a human being. The beauty of GeckoSystems’ AI platform is that it can run on common PC hardware and operating systems like Windows XP and Linux, keeping down costs. Spencer estimates that the CareBot can pay for itself in a matter of months, due to the high cost of assisted care.

Along with my colleague Patrick Cox, I am closely investigating advancements such as CareBot, along with other opportunities in this space. These life-changing technologies will become commercialized sooner than you may think.
